Note: The petitioner and the unit-appointed respondent may be accompanied by an advisor and may have an advisor act on their behalf throughout the hearing proceedings listed below. An advisor may not provide testimony on behalf of a party. If a petitioner does not appear at the beginning of the hearing, the hearing will be cancelled. If a unit-appointed respondent does not appear at the beginning of the hearing, the unit-appointed respondent’s advisor may still participate in the hearing as listed below but may not provide testimony on behalf of the unit-appointed respondent.
- Call to order, announcements, and opening remarks by the hearing officer.
- Presentation of the petition by the hearing officer including a description of one or more specific written University rules, policies, or procedures pertaining to employment alleged to have been violated.
- The petitioner and/or their advisor may provide opening comments (up to 5 minutes).
- The unit-appointed respondent and/or their advisor may provide opening comments (up to 5 minutes).
Party case presentations (up to 2 hours each). Each party’s case presentation includes direct testimony and/or examination of the party and the party’s witness(es), if any, as well as cross-examination of the opposing party and the opposing party’s witness(es), if any. If a witness is not available at the time called, the hearing will not stop. If the party has not exhausted their allotted time, they may reserve up to 10 minutes total for recall/follow-up questions (see “Final Recall” items 7 and 8 below).
- Petitioner presents information:
- The petitioner may present direct testimony and/or the petitioner’s advisor may ask questions of the petitioner. This uses the time allotted for the petitioner’s case presentation.
- The unit-appointed respondent and/or their advisor may cross-examine the petitioner. This uses the time allotted for the unit-appointed respondent’s case presentation.
- The hearing panel may ask any questions it has for the petitioner.
- Petitioner’s witness(es), if any (repeat for each witness):
- The petitioner and/or their advisor may ask questions of the witness. This uses the time allotted for the petitioner’s case presentation.
- The unit-appointed respondent and/or their advisor may cross-examine the witness. This uses the time allotted for the unit-appointed respondent’s case presentation.
- The hearing panel may ask any questions it has for the witness.
- Unit-appointed respondent presents information:
- The unit-appointed respondent may present direct testimony and/or the unit-appointed respondent’s advisor may ask questions of the unit-appointed respondent. This uses the time allotted for the unit-appointed respondent’s case presentation.
- The petitioner and/or their advisor may cross-examine the unit-appointed respondent. This uses the time allotted for the petitioner’s case presentation.
- The hearing panel may ask any questions it has for the unit-appointed respondent.
- Unit-appointed respondent’s witness(es), if any (repeat for each witness):
- The unit-appointed respondent and/or their advisor may ask questions of the witness. This uses the time allotted for the unit-appointed respondent’s case presentation.
- The petitioner and/or their advisor may cross-examine the witness. This uses the time allotted for the petitioner’s case presentation
- The hearing panel may ask any questions it has for the witness.
Final recall. Opportunity for a few brief, clarifying questions of the petitioner and/or the unit-appointed respondent if they have not yet exhausted their allotted case presentation time. Witnesses may not be recalled.
- Final recall of the petitioner, if any.
- The petitioner may present any final, clarifying information and/or the petitioner’s advisor may ask final questions of the petitioner (up to 5 minutes). This uses the time allotted for the petitioner’s case presentation.
- The unit-appointed respondent’s advisor may ask final questions of the petitioner (up to 5 minutes). This uses the time allotted for the unit-appointed respondent’s case presentation.
- The hearing panel may ask final questions for the petitioner (up to 5 minutes).
- Final recall of the unit-appointed respondent, if any.
- The unit-appointed respondent may present any final, clarifying information and/or the unit-appointed respondent’s advisor may ask final questions of the unit-appointed respondent (up to 5 minutes). This uses the time allotted for the unit-appointed respondent’s case presentation.
- The petitioner’s advisor may ask final questions of the unit-appointed respondent (up to 5 minutes). This uses the time allotted for the petitioner’s case presentation
- The hearing panel may ask final questions for the unit-appointed respondent (up to 5 minutes).
- Closing comments from the petitioner and/or their advisor (up to 10 minutes).
- Closing comments from the unit-appointed respondent and/or their advisor (up to 10 minutes).
- The hearing officer adjourns the hearing.
